Legal assessment
Crypto casinos accept stakes in cryptocurrencies, but legally fall under the same Austrian licensing requirement as classic online casinos. We reconstruct the stakes and payouts from the wallet transactions.
Sports betting is fundamentally legal in Austria, unlike online casinos. A reclaim is possible via partial legal incapacity under Section 865 Austrian Civil Code. The pathological gambling addiction during the loss period is established by an expert opinion in the proceedings; we organise the specialist medical report together after instruction. Litigation is generally economically viable from around 50,000 euros in losses per provider.
The litigation route applies regardless of where the betting provider is based. Even online betting providers licensed in Austria can be sued, as long as the betting relationship arose online. Betting cafes with cash on site are a different constellation.
