Bet365 is one of the largest betting and casino groups worldwide

Bet365 is known in the German-speaking region above all as a sports betting brand. The contracting party for sports betting is Hillside (Sports) ENC, based in Ta’ Xbiex, Malta. The casino segment runs through a separate Maltese company with an MGA licence (MGA/CRP/531/2018-02). Bet365 relocated its operational hub fully from Gibraltar to Malta in early 2026.

For Austria, there is no nationwide licence for either casino or online sports betting.

What a reclaim at Bet365 means

Casino losses: Without an Austrian licence, the contract with the casino segment is void. Stakes can be reclaimed retroactively for up to thirty years according to the settled case law of the Austrian Supreme Court (OGH).

Betting losses: A reclaim is only possible via partial legal incapacity under Section 865 Austrian Civil Code. The requirement is a pathological gambling addiction during the loss period, which is established by an expert opinion in the proceedings. We organise the specialist medical report together after instruction. The litigation route applies regardless of the provider’s location, as long as the betting relationship arose online. Litigation generally becomes economically viable from around 50,000 euros in losses.

The litigation route is Austria, with the consumer place of jurisdiction at the place of residence.
