Casino division discontinued. The operating casino company bet-at-home.com Entertainment Ltd. (Malta) was filed for winding up on 23.12.2021 and deconsolidated from the group accounts on 13.05.2022 (insolvency, court-ordered liquidation). Background: Austrian courts declared online casino operation in Austria unlawful, after which operation was discontinued in October 2021. In its ruling of 20.08.2024, the Austrian Supreme Court (OGH) found that bet-at-home.com Internet Ltd. is liable for the liabilities of Entertainment Ltd. The sports betting site (bet-at-home.com) continues to operate through bet-at-home.com Internet Ltd. (MGA/CRP/278/2004, status: Licensed), but without a casino area. The casino area was accessible at www.bet-at-home.com/de/casino, now no longer active (404). The address and MGA licence refer to bet-at-home.com Internet Limited (sports betting, active licence). Entertainment Ltd. had a separate (revoked/expired) licence.

Online casino offerings aimed at Austrian players require a licence in Austria. Without this licence under the Gambling Act, the underlying contract is void. According to the settled OGH line, losses can be reclaimed retroactively for up to thirty years.

Sports betting, unlike online casinos, is generally legal in Austria. A reclaim is possible through partial legal incapacity under Section 865 Austrian Civil Code. The pathological gambling addiction during the loss period is established by an expert opinion in the proceedings, and we organise the medical report together after you instruct us. As a rule, a claim is economically viable from around 50,000 euros of losses per provider.

The legal route applies regardless of where the betting provider is based. Even Austrian-licensed online betting providers can be sued, as long as the betting relationship arose online. Betting cafés with cash on site are a different constellation.
