Betway offers sports betting, casino and poker under one brand

Betway has been on the market since 2006 and operates in the German-speaking region with sports betting, casino games and poker. The contracting party for all three areas is Betway Limited, based at 9 Empire Stadium Street, Gzira, Malta (company register number C39710). The platform holds an MGA licence. Since 2020, Betway has belonged to Super Group, a holding company listed on the New York Stock Exchange.

For Austria, there is no nationwide licence under the Gambling Act for any of the three areas.

What a reclaim at Betway means

Casino losses: Without an Austrian licence, the contract with Betway Limited is void. Under settled case law of the Austrian Supreme Court (OGH), stakes can be reclaimed for up to thirty years.

Poker losses: The OGH has clarified that online poker also requires a licence. Here too, the contract with Betway Limited is void and stakes can be reclaimed.

Betting losses: Sports betting is legal in Austria. A reclaim is only possible through partial legal incapacity, and is economically sensible from around 50,000 euros in losses.

The route to court in Austria is at your place of residence as a consumer. Judgments by Austrian courts already exist against the Maltese Betway Limited.

Casino and poker losses run through the voidness of the contracts, betting losses through partial legal incapacity. We bundle this where possible and litigate separately where it is legally cleaner.

Does it matter that Betway belongs to Super Group?

The contracting party remains the Maltese Betway Limited. The parent group is only relevant when you want to know whether, in the end, someone is also able to pay.

How long does it take?

We plan for two to three years. Providers of this size often exhaust all instances.
