Bwin is the best-known online betting brand in the DACH region

Bwin has been on the market since 1997 and today belongs to Entain plc (listed in London). The contracting party for the online business in the DACH region is ElectraWorks Europe Limited, based in the Portomaso Business Tower, St. Julian’s, Malta. The platform combines sports betting, casino and poker under one brand.

For Austria, there is no nationwide licence under the Gambling Act for any of the three segments.

What a reclaim at Bwin means

Casino losses: Without an Austrian licence, the contract with ElectraWorks Europe Limited is void. Stakes can be reclaimed for up to thirty years.

Poker losses: According to the OGH, online poker is also subject to the gambling monopoly. Here too the contract is void, and stakes can be reclaimed.

Betting losses: Sports betting is legal in Austria. The reclaim runs via partial legal incapacity under Section 865 Austrian Civil Code, and the pathological gambling addiction is established by an expert opinion. The claim route applies regardless of the provider’s registered office, as long as the betting relationship arose online. As a rule, this is economically viable from around 50,000 euros.

Bwin has a very broad litigation history in Austria. There are several final and binding judgments against ElectraWorks Limited, both in the casino segment and in individual cases in the sports betting area.

Frequently asked questions about Bwin

Bwin does have a betting licence, doesn’t it?

Bwin has a licence in Malta, not in Austria. According to the OGH, a Maltese licence does not replace the licence under the Austrian Gambling Act.

What about the sports betting share of my losses?

Sports betting is legal in Austria, and the claim route runs via partial legal incapacity. In the initial consultation we examine whether the economic threshold is reached and whether there is an approach that can be supported by an expert opinion.

Does the CJEU judgment C-440/23 also apply to Bwin?

Yes. The final judgment of 16 April 2026 once again confirmed that stakes can be reclaimed from providers without a national licence.
