According to our research, the contracting party of Cashpoint is Merkur Bets Malta Limited (formerly: CASHPOINT (Malta) Ltd.; renamed as of 3 June 2025), with its registered office in Malta, St. Julian’s. The platform holds a licence from Malta (MGA/B2C/114/2005).

Legal assessment

Online casino offers that target Austrian players require a licence in Austria. Without this licence under the Gambling Act, the underlying contract is void. According to the settled line of the Austrian Supreme Court (OGH), losses can be reclaimed retroactively for up to thirty years.

Sports betting, unlike online casinos, is in principle legal in Austria. A reclaim can be considered via partial legal incapacity under Section 865 Austrian Civil Code. The claim route applies regardless of where the betting provider is based. Online betting providers licensed in Austria can also be sued, as long as the betting relationship arose online. Betting cafes with cash on site are a different constellation.
