Legal assessment

Online casino offers aimed at Austrian players require a licence in Austria. Without this licence under the Gambling Act, the underlying contract is void. According to the established line of the Austrian Supreme Court (OGH), losses can be reclaimed retroactively for up to thirty years.

Online poker too is subject to the Austrian gambling monopoly under the OGH line and therefore requires a licence. Providers without an Austrian licence breach the Gambling Act, contracts are void, and stakes can be reclaimed.
