Tipico is known in the DACH region above all as a sports betting brand

Tipico has been on the market since 2004 and has a massive presence in the German-speaking region (advertising, sponsoring, betting shops). The online contracting party is Tipico Games Ltd. (casino) and Tipico Co. Ltd. (sports betting) respectively, based in St. Julian’s, Malta. The platform holds an MGA licence.

For Austria there is no nationwide licence under the Gambling Act, neither for the casino business nor for online sports betting.

What a reclaim at Tipico means

Casino losses: Online casino offers require a licence in Austria. Without this licence the contract with the Tipico casino company is void, and stakes can be reclaimed for up to thirty years according to the OGH.

Betting losses: Sports betting is legal in Austria. A reclaim works via partial legal incapacity under Section 865 Austrian Civil Code, and the pathological gambling addiction is established by expert opinion. The route to a claim applies regardless of the provider’s registered office, as long as the betting relationship arose online. As a rule, it is economically viable from around 50,000 euros in losses.

In proceedings, Tipico usually defends itself actively and uses several instances. We plan for the duration of proceedings accordingly. Nothing changes for you: we bear the legal and proceedings costs.

How we proceed

The assessment is free of charge. We litigate at our own cost. If successful, R. M. Prozessfinanzierung GmbH retains from 35 percent of the amount obtained, and the remaining amount goes to you. Legal representation is handled by cooperating lawyers.

Advertising is one thing, the licence question is another. According to the OGH, a Maltese MGA licence does not replace the licence under the Austrian Gambling Act.

What if I only placed sports bets?
