Legal classification
According to the line of the Austrian Supreme Court (OGH), online poker is also subject to the Austrian gambling monopoly and therefore requires a licence. Providers without an Austrian licence breach the Gambling Act, the contracts are void, and stakes can be reclaimed.
Sports betting is generally legal in Austria, unlike online casinos. A reclaim can be considered through the partial legal incapacity under Section 865 Austrian Civil Code. The pathological gambling addiction during the loss period is established by an expert opinion in the proceedings, and we organise the medical specialist’s report together after you instruct us. As a rule, a claim is economically viable from around 50,000 euros of losses per provider.
The litigation route applies regardless of where the betting provider is based. Even Austrian-licensed online betting providers can be sued, as long as the betting relationship arose online. Betting cafes with cash on site are a different constellation.
