A common assumption is that old gambling losses have become time-barred anyway. With providers that have no Austrian licence, this is often not the case.
Up to 30 years retroactively
If an online casino has no Austrian licence, the gaming contracts are not binding under civil law. Reclaim claims can reach back up to 30 years, depending on how the case is structured. This applies regardless of whether the losses arose through slot machines, slots, poker, roulette or black jack. How far your claims reach depends on the individual case and on whether the provider has become insolvent in the meantime.
Losses with cryptocurrencies too
Cryptocurrencies are increasingly being used in gambling as well. Using them as a means of payment is permitted, but this does not change the fact that a provider without an Austrian licence does not offer its services lawfully. Losses that arose in Bitcoin, Ethereum or other coins can therefore likewise be reclaimed. The transactions can be traced well via the blockchain.
How the assessment works
After your enquiry, we assess your claims, determine the exact amount of the losses and help with obtaining the necessary documents. If the assessment is positive, cooperating lawyers file the claim against the provider.
The assessment is free of charge. We conduct the proceedings at our cost, and no upfront payment is due from you. In the event of success, the R. M. Prozessfinanzierung GmbH retains from 35 percent of the amount awarded, and the remaining amount is paid out to you.
