Partypoker is the poker platform of the Entain group

Partypoker has been on the market since 2001 and was for a long time one of the largest poker providers worldwide. The contracting party is Martingale Europe Ltd., based in Gzira, Malta. The platform holds an MGA licence and offers, alongside poker (cash games, tournaments), also casino games and sports betting.

For Austria, none of the segments holds a nationwide licence under the Gambling Act.

What a reclaim at Partypoker means

Poker losses: The OGH has clarified that online poker too is subject to the gambling monopoly and requires a licence. Without a licence, the contract with Martingale Europe Ltd. is void, and stakes can be reclaimed according to the settled line. Limitation period up to thirty years.

Casino losses: Same legal basis as poker.

Betting losses: Sports betting is legal in Austria. A reclaim is only possible through partial legal incapacity under Section 865 Austrian Civil Code.

Litigation route in Austria at the place of residence as a consumer.

How we proceed

The assessment is free of charge. We litigate at our own cost. In the event of success, R. M. Prozessfinanzierung GmbH retains from 35 percent of the amount won, and the remaining amount goes to you. Legal representation is handled by cooperating lawyers.

Important with poker: We do not record the win-loss balance per hand, but the net deposits less withdrawals over the entire period. Tournaments and cash games are considered together.

Isn’t online poker a game of skill?

The OGH has expressly decided that online poker falls under the Austrian gambling monopoly. This question has been settled at the highest court level.

How does this work with cash games against other players?

The contracting party is Partypoker, not your fellow players. You deposited the money with Partypoker, and that is where it was lost. You turn to Partypoker.

What if I received a rake reduction or bonus?

This is offset. The decisive figure is the net loss. We do the exact calculation on the basis of your account statements in the initial consultation.
